Conditions of use
1. PREAMBLE
These general terms and conditions of sale apply to all commercial transactions concerning the products offered for sale by the torrefactory project sa/nv within its torrefactory project internet shop, to the exclusion of all other conditions (unless expressly waived in writing and mutually agreed by the parties). The mere fact of placing an order through the torrefactory project website implies acceptance of the general terms and conditions set out below.
2. DEFINITIONS
The terms used in these General Terms and Conditions or on the torrefactory project website should be understood as follows: 2.1. torrefactory project: the website of the torrefactory project sa/nv on which the products are presented and sold to customers. all domains (.be, .lu, .fr, .nl,...) and linked urls are included under the name torrefactory project. 2.2. customer: any natural or legal person, legally capable and over 18 years of age, who places an order for product(s) through the torrefactory project website. 2.3. order: request for the conclusion of a sales contract by the customer between the torrefactory project sa/nv and the customer of the torrefactory project internet shop concerning the products presented by torrefactory project. 2.4. product listing: refers to the information (text, photos, graphics, classification system by category, etc.) related to a product offered for sale on the torrefactory project site. 2.5. Products: all goods offered for sale by the torrefactory project sa/nv through the torrefactory project Internet Boutique. 2.6. Transaction: all operations, secure processing, authorizations and agreements related to the payment of products ordered by credit card or any other virtual transaction method offered on the site.3. ACCEPTANCE OF THE CONDITIONS
The customer acknowledges having read these general terms and conditions of sale and, by placing the order, expressly accepts them without reservation.4. SUBJECT
The torrefactory project sa/nv offers products for sale online (article 5) revolving around coffee, tea and infusions. the customer logs on to the website and, by filling his/her shopping basket, places an order for the products he/she has chosen while browsing the site (article 6). the products purchased are paid for online using one of the solutions offered on the site (article 8). torrefactory project confirms acceptance of the order by e-mail and the products are delivered to the customer within a specified period (article 7).5. PRODUCTS
Only products for which a "product sheet" is published on the torrefactory project website can be sold.6. ORDERING
6.1. all information provided by the customer, during the encoding of the data inherent to his/her order, is binding. torrefactory project can in no way be held responsible for errors made by the customer in the wording of the coordinates of the recipient of the order (delivery address, billing address in particular) and for delays in delivery or the impossibility of delivering the products ordered that these errors could cause.6.2. automatic recording systems are proof of the nature, content and date of the order.
6.3. upon receipt of an order, torrefactory project confirms acceptance of the order by sending a confirmation message to the e-mail address provided by the customer when registering the order. the sale will only be concluded once the order confirmation has been sent.
6.4. in general and without justification, torrefactory project reserves the right to refuse or cancel any order from a customer, in particular in the event of a payment problem for the order in question or a dispute relating to the payment of a previous order.
6.5. with the exception of the "on demand" category, almost all products are in stock. if the product ordered is not or is no longer available immediately, torrefactory project informs the customer of the delivery time by email. if the customer is not satisfied with the delivery time, he may choose to modify or cancel his order.
6.6. orders may only be placed by legally competent persons.
7. DELIVERY
7.1. upon confirmation of the order and acceptance of payment by the transaction processor, torrefactory project undertakes to ship the ordered products to the customer at the delivery address indicated within a period of time generally ranging from 1 to 3 business days depending on the destination. all details concerning delivery times are available on the torrefactory project website. 7.2. by placing an order, the customer undertakes to pay, upon receipt of the goods, all taxes, duties, levies and other present and future charges due in respect of the delivery of the ordered products. the torrefactory project sa/nv shall not be held jointly and severally liable in this respect. 7.3. delivery is carried out by bpost and in belgium only. delivery rates and delivery times are available on the torrefactory project website. no compensation may be claimed from the torrefactory project or the carrier by the client in the event of late delivery. 7.4. upon receipt of the ordered products, the client or recipient must verify the good condition of the delivered product. in the event that one or more of the ordered products are missing or damaged, the client or recipient must immediately make the necessary reservations to the carrier at the time of delivery. 7.5. if a parcel is not received despite the carrier's various visits (maximum three visits), it will be returned to torrefactory project and the recipient will be notified by e-mail. an additional delivery may be requested by the buyer and the buyer will bear the costs thereof (even if the first shipment was made free of charge). 7.6. customers or recipients of the products are prohibited from reselling all or part of the products purchased.8. WITHDRAWAL
8.1. in accordance with current legislation governing distance selling (law of July 14, 1991), the customer has the right to cancel his purchase without penalty and without giving any reason. the customer has 14 calendar days from receipt of the products ordered to return them to torrefactory project for exchange or refund. to obtain a refund or exchange, the customer must return the new products (with the delivery note) in their original packaging, undamaged and with all accessories (including user manuals and documentation) to the following address: torrefactory project logistics center the torrefactory project sa/nv Rue des griottes, 20 5100 wépion Belgium, at the customer's expense and responsibility.8.2.If the products are returned to torrefactory project within the aforementioned conditions and deadlines, torrefactory project undertakes to reimburse the sums paid by the customer, (with the exception of shipping costs), free of charge.
8.3 CONDITIONS SPECIFIC TO WORKSHOPS
Registrations for our coffee workshops can be cancelled free of charge up to 48 hours before the event.
All requests for cancellation made within this period will result in a full refund of the amount paid. Requests must be sent by e-mail to hello@torrefactory.coffee, and the date of receipt of the message will be taken as proof that the 48-hour deadline has been met. After this period, no cancellation or refund will be possible, except in cases of force majeure at Torrefactory's discretion.
It is however possible to transfer participation to another person, on simple request by e-mail before the start of the workshop.
9. PRICE
9.1. the price indicated on the product sheets does not include transport costs. 9.2. the price indicated in the order confirmation is the final price, including all taxes and including vat. this price includes the price of the products, handling, packaging and storage costs, and shipping costs. 9.3. torrefactory project reserves the right to modify the price of the products at any time, but the products are invoiced on the basis of the prices in effect at the time the orders are registered.10. PAYMENT
10.1. the price of the products is payable in cash by one of the means of payment proposed on the site on the day the order is placed.10.2. protection against fraudulent use of the means of payment used for the transaction, in particular as a result of piracy, as well as against any challenges to payment of the price of an order, is provided by the stripe company. 10.3. the order validated by the customer only becomes effective when the secure bank payment center and the stripe company have given their agreement to the execution of the transaction. in the event of refusal by the secure bank payment center or the stripe company, the order will be automatically cancelled and the customer notified by e-mail.
10.4. information relating to the order is subject to automated data processing, for which stripe is responsible. the purpose of this automated data processing is to combat credit card fraud. stripe and torrefactory project are the recipients of the data relating to the order. in the event of fraudulent use of a bank card, irregular declaration or anomaly, the details relating to the order associated with this non-payment may be entered in a payment incident file.
11. RESPONSIBILITY
11.1. torrefactory project and the torrefactory project sa/nv cannot in any way be held liable for damages of any kind that may result from improper use of the products sold.11.2. neither torrefactory project nor the torrefactory project sa/nv may be held liable for any modifications made to the products by the manufacturers.
11.3. the liability of torrefactory project or the torrefactory project sa/nv shall in any event be limited to the amount of the order, and shall not be held liable for simple errors or omissions which may persist despite all the precautions taken in the presentation of the products. in particular, the photos presented on the site are provided for information purposes only. under no circumstances may a modification be made to the container or contents of a product in the event of a discrepancy with the photo available on the site. the instructions published in the product data sheets are for information only. the customer undertakes to read carefully the instructions displayed by the manufacturer on or in the product packaging. it is these instructions which contain the information (and in particular dosages and contraindications) which the user must follow.
